Business Owners — Retirement Plan Adoption Deadline Approaching March 15
For S-Corporations and Partnerships, the deadline to adopt a traditional 401(k) plan for the prior tax year is March 15, 2026. For corporations and sole proprietors, the deadline is April 15, 2026. These dates apply to calendar-year plans and may be extended if a tax filing extension is requested.
Under the SECURE Act provisions, business owners may retroactively establish a 401(k) plan up to their tax filing deadline, including extensions. Only employer contributions may be made retroactively; employee deferrals are not permitted.
